美國加州於1986年開始實施「安全飲用水及有毒物質法案」 (The Safe Drinking Water and Toxic Enforcement Act)，又稱為加州65法案，主要是推廣安全、乾淨的飲用水，並促使消費性產品不含會導致癌症或畸形兒的有毒物質。法規精神為：「從事商業行為的任何人，不得將危害物質於未經告示下販售給消費者。」4 |( e+ G2 `( P8 v, A* }9 c" a

California Prop 65 affects all products sold or distributed in California, including: Toys, Clothing, Cosmetics, jewellery, Electrical devices, Wires & Cables, etc.

Firms doing business in California and exposing individuals to chemicals “known to the State” to cause cancer, birth defects or reproductive toxicity must:

(1) Provide clear and reasonable warning9 @, @+ O+ u, j6 W
(2) Do not discharge listed chemicals into drinking water7 f8 ]7 |0 q2 _9 u

$ g5 t4 N/ S" F4 v6 p9 N0 E: K5 l% H0 f# {. l! l/ \0 ^
(1) A warning must be given for listed chemicals unless exposure is low enough to pose no significant risk.0 v3 }" L2 V: H. B! c/ r
(2) Warning labelling is required if the product does not meet the requirements of Proposition 65., I: l- N- Q8 j; n" ^
(3) The warning message must clearly communicate that the chemical in question is known to the State (California) to cause adverse effects. |
