Improvement Act of 2008 (‘‘CPSIA’’),

Commission is staying certain of the
% J6 h8 h, U* H; i5 rrequirements of paragraphs 14(a)(1), (2),
0 f( G. A n! ]3 pand (3) that otherwise require testing, |2 Y1 P% U+ r7 O
and issuance of certificates of- }) `0 ~8 L# I
compliance by manufacturers, including- U% a- |4 F- X% L
importers, of products subject to an: G" [7 s8 d% A
applicable consumer product safety rule6 S3 ]2 u1 G8 n* D
as defined in the CPSA or similar rule,: r: g( `, _ s' x: s U1 P
ban, standard, or regulation under any0 R5 N# F% Y8 i1 [, F& V
other Act enforced by the Commission. M0 N: w+ u: a* N) u+ P' l. p
This stay covers all such requirements( K+ |6 F& e- M9 J) v/ a
with the exception of:
- N: r% o3 B( \: X8 P/ M$ O; l(1) Those where testing and6 x1 {, c6 Z2 N' T, ~
certification was required by subsection
4 Y4 v3 L* [6 v14(a) of the CPSA prior to enactment of

become effective, applicable to

laboratories to test for:

pacifiers (effective for products

• Small parts (effective for products k# j9 W K" W
manufactured after February 15, 2009),. a$ N/ O1 a! h5 Z8 m) e# O; Q

• Metal components of children’s
6 ] U0 F4 C7 P+ `' Z8 V2 ^metal jewelry (effective for products+ a1 R+ O) ]9 l- [
manufactured after March 23, 2009);

9 B1 ^6 y$ s* F E5 Z5 z(3) Any and all certifications' }" R4 h7 a+ I, d* t
expressly required by CPSC regulations;8 ?8 H. j) A" U+ v

(4) The certifications required due to
% F K& p5 k$ d# ]; t' f5 ^. @+ Acertain requirements of the Virginia* a5 y1 g( H1 O$ V5 s# g2 g
Graeme Baker Pool & Spa Safety Act
) h% e X' B# M' a- Fbeing defined as consumer product2 ]3 y( W: B, T4 I1 u
safety ‘‘rules;’’ and1 ]! \' h6 Y& M' F5 A* A
(5) The certifications of compliance# O) L$ O {2 `& T' @. e8 h9 L$ v8 L
required for ATVs in section 42(a)(2) of. P5 R( y* k* q9 k
the CPSA which were added by CPSIA;4 q& m" N/ O: [

(6) Any voluntary guarantees
& T$ n0 K% S% e7 y- b9 Mprovided for in the Flammable Fabrics8 ~6 X& W7 \, {: h8 h& k
Act (‘‘FFA’’) or otherwise (to the extent5 }+ T- u2 G8 O, e% {( U
a guarantor wishes to issue one).
: i1 m. E% q7 bThis stay will remain in effect until, p2 U2 y. ~- s& x$ @# P
February 10, 2010, at which time the
/ }" Y- B0 S2 C: J) X9 d( ~Commission will vote to terminate the
$ y( B( [- e( C5 U) f2 vstay. This stay does not alter or
; A! j2 d5 I Z4 e1 | X6 {postpone the requirement that all
7 F2 F6 C; d0 k4 A6 ^! g7 z5 ]products meet applicable consumer. b! C9 A7 z: l( X* J
product safety rules as defined in the
