decision of the Consumer Product

* _5 f" T9 ]0 y# T0 q‘‘Commission’’) to stay enforcement of, O# S6 g/ D/ a Z
certain provisions of subsection 14(a) of# [/ S' x! {% H; q, t7 |
the Consumer Product Safety Act
( b; S7 T8 w0 `: K- n5 @(‘‘CPSA’’) as amended by section 102(a)
$ @% S3 A' ^2 uof the Consumer Product Safety
: o' {1 T, E: }( y* X1 d- lImprovement Act of 2008 (‘‘CPSIA’’),
3 w3 U1 U) u* B& F1 jPublic Law 110–314. Specifically, the
" b" Q# p8 }9 O3 i: F0 E+ uCommission is staying certain of the
0 j7 w3 j" b, j2 R: |3 |4 krequirements of paragraphs 14(a)(1), (2),
4 j! T9 M& F+ p5 Iand (3) that otherwise require testing
5 V% W9 I5 _) Eand issuance of certificates of- P! y$ j% \2 n. l6 t& g1 p1 T- W
compliance by manufacturers, including
1 _: X$ `/ s0 y* ]# T. ~2 l9 Mimporters, of products subject to an
' i5 v! }! d% ~6 D3 t$ Q/ s* happlicable consumer product safety rule
2 u/ j0 G. `0 was defined in the CPSA or similar rule,1 p6 d6 b' |3 |4 c1 S
ban, standard, or regulation under any
5 U3 Z3 ^$ D- w9 M' a. Y, ^8 T" b+ Rother Act enforced by the Commission.6 q6 a/ \: p8 \! ]4 r" c
This stay covers all such requirements
' P3 \* V. I/ ^with the exception of:( b" q9 g6 l4 Y0 v) x# ~
(1) Those where testing and6 y' X/ i' x* F2 }- P8 N
certification was required by subsection
- Z2 \& O9 ]# j: @' I5 l9 D14(a) of the CPSA prior to enactment of" e( g4 v5 P& R% Z; s
the CPSIA; and

become effective, applicable to. j! ^! R' j- @$ i
children’s product certifications
$ V0 ]# P5 K+ d: A% F8 o+ F; g& qrequired to be supported by third party
0 M+ [/ H0 h( }+ O( q# B" p% `testing for which the Commission has5 L8 C7 Z* G3 _7 \. A# G. {
issued requirements for acceptance of
; y% ^+ J- s) Kaccreditation of third party testing
) s7 C7 G. z" }laboratories to test for:/ @1 F- S7 u7 N; Q$ p% @, C
• Lead paint (effective for products
: p' ^. `9 n/ i: S9 }manufactured after December 21, 2008),* }+ R: x4 I% m7 V7 b2 A9 q. [
• Full-size and non-full size cribs and: `7 H& z9 C) W) g/ t
pacifiers (effective for products
4 g- d2 E/ F2 e" J" |4 dmanufactured after January 20, 2009),5 G+ [. \- e8 Z6 V
• Small parts (effective for products
6 m- {+ k Y9 R& i4 \- T0 J9 d% B- tmanufactured after February 15, 2009),
- S4 t: r# I! v' ]and
" A4 l% d7 J' Q; K6 e$ a' D• Metal components of children’s
4 B1 D+ U2 w; Nmetal jewelry (effective for products ^8 t: ~/ S1 e- E! f- z1 I, G# A
manufactured after March 23, 2009); w" j8 P) k( u
and! q+ R9 n) s. [; A2 Y. D- b
(3) Any and all certifications! P3 A/ O0 I5 q
expressly required by CPSC regulations;

certain requirements of the Virginia# N i$ z% Z/ j$ B# s' B0 G
Graeme Baker Pool & Spa Safety Act
$ y. g# B" L- J ^being defined as consumer product* n1 t& T8 K: [! U. W# w
safety ‘‘rules;’’ and* J% k2 v# x6 K$ I/ _
(5) The certifications of compliance; n( l8 F: C# K2 { }5 Q r: ~
required for ATVs in section 42(a)(2) of
$ j+ U/ k# G" T/ ~2 e6 n. k2 Jthe CPSA which were added by CPSIA;
: y$ v" C* n4 \. {. V2 ~and4 z6 M2 j$ B2 m$ v* b2 T
(6) Any voluntary guarantees' c* f4 C7 ^' X) t1 l# U5 K
provided for in the Flammable Fabrics ~; z* t8 C* f; ^' s* B
Act (‘‘FFA’’) or otherwise (to the extent0 {# E3 l8 }" E; j% O
a guarantor wishes to issue one)., @+ u M c5 Q: h% A
This stay will remain in effect until# d1 k" F5 y. w: ]
February 10, 2010, at which time the$ \ N4 ~. k5 T' ?9 ]+ J
Commission will vote to terminate the% [0 j1 F5 c( T2 l' v# n) q! S
stay. This stay does not alter or
* O* [- V0 R1 h: u* Q/ kpostpone the requirement that all, l% V" H1 m0 ^8 m7 F* v6 v9 v
products meet applicable consumer
7 p2 K. C' g6 y$ a$ _product safety rules as defined in the
/ K' q0 B8 g4 f3 W8 K9 H5 QCPSA or similar rules, bans, standards,

enforced by the Commission.
