(‘‘CPSA’’) as amended by section 102(a)

Improvement Act of 2008 (‘‘CPSIA’’),
- B' ^/ _% o/ h& _1 z3 |7 x S( KPublic Law 110–314. Specifically, the" }6 k1 a2 I3 K2 q- e
Commission is staying certain of the
|+ M- u/ a$ Mrequirements of paragraphs 14(a)(1), (2),
, r" q- f0 }' j6 qand (3) that otherwise require testing
* j) p* c' l2 s$ _! j6 Tand issuance of certificates of- Q5 T [5 F0 M
compliance by manufacturers, including' b5 O0 L7 [) m( p" ]0 X9 @
importers, of products subject to an
0 C) i; m, y' W0 z- S. ^applicable consumer product safety rule
, T& ^, P# r5 Y) J% u: q9 bas defined in the CPSA or similar rule,
- f# m l+ R' q) I8 U ?" Cban, standard, or regulation under any$ N% y" ]* Z: k; q! d
other Act enforced by the Commission.& ]2 A) y! G6 D: T4 D+ k& a
This stay covers all such requirements
5 [+ h% h; Q+ R5 ~" @with the exception of:/ x$ X r6 d$ }+ E/ c3 o
(1) Those where testing and
b# _4 d. z1 T- t! W; [' `certification was required by subsection" E) e; i' q: p5 J) [& ]0 `5 l
14(a) of the CPSA prior to enactment of
& u, }# Z' H5 t' \the CPSIA; and, W2 Z& O2 `, X) b- h
(2) Those requirements, when they
( P. g* U6 @2 `- t! h) obecome effective, applicable to9 C6 l# r5 L. h; j! `: t
children’s product certifications4 F3 L$ h0 V1 s( J
required to be supported by third party& O( ]7 f$ ~# w% {
testing for which the Commission has3 M- }+ n# y, O% [
issued requirements for acceptance of
( G; U1 [! \# w% Q6 ^accreditation of third party testing
8 D% n% m/ X, o Elaboratories to test for:6 h C2 I! ]+ t
• Lead paint (effective for products
! {4 o& j: ]; q0 k$ Vmanufactured after December 21, 2008),! z6 {8 r; O0 n
• Full-size and non-full size cribs and3 ?3 A! `& I! B' O' ]# y5 a
pacifiers (effective for products
1 D6 k% L0 r1 N. omanufactured after January 20, 2009),
! s+ ~7 t3 `6 i1 _* o/ a• Small parts (effective for products
+ U% L$ E! N& @8 T3 |# hmanufactured after February 15, 2009),
# H+ F; ~, d, o+ B/ s6 C# [' uand! E0 B* ~+ J4 W1 _9 o8 f
• Metal components of children’s, m4 ~2 W) d" k# K" E
metal jewelry (effective for products
$ Q$ p7 ?0 b' r; g" d; ?: lmanufactured after March 23, 2009);

(3) Any and all certifications
/ g6 L; N1 R/ g; m1 T/ Jexpressly required by CPSC regulations;, g" W' P8 A3 Z" Y, l4 D

(4) The certifications required due to" Y2 C3 i5 q4 s# M3 ]
certain requirements of the Virginia
5 ~8 G& V: G- X: N. a' [% v1 EGraeme Baker Pool & Spa Safety Act t8 r% J- S5 g2 X; m- a, E% _8 l
being defined as consumer product5 C" C9 Z7 _) \0 N- G( G9 p
safety ‘‘rules;’’ and
0 F3 E$ I% G4 j9 [! }6 ]/ ~(5) The certifications of compliance% O, e# r5 @4 N' C, Y
required for ATVs in section 42(a)(2) of, C6 U/ M' o# P# I
the CPSA which were added by CPSIA;; V; m: Q& O2 _
and
8 e5 w- ? i2 ~+ S( x0 T; H(6) Any voluntary guarantees0 G2 [; d2 i: ?0 G; C
provided for in the Flammable Fabrics
- B: c7 c- c6 ~$ CAct (‘‘FFA’’) or otherwise (to the extent3 l1 J Y) }: A3 F/ b, X
a guarantor wishes to issue one).$ Y$ V# g, n- S/ X
This stay will remain in effect until
3 n; B1 L7 |* ~9 ^! I* c' f2 FFebruary 10, 2010, at which time the% d% l3 ~" I) j6 s, e+ r
Commission will vote to terminate the
; r* `6 I* @/ r5 ]* K: Estay. This stay does not alter or
t. a7 E/ @9 _postpone the requirement that all
+ K% |' D* o! `4 Y e# c9 qproducts meet applicable consumer8 V* _8 \, j1 k$ e5 X. s' V
product safety rules as defined in the
' V1 g$ I+ Y: ?) K3 \+ h4 ^CPSA or similar rules, bans, standards,2 _# h- w: w' s! P. ~
or regulations under any other Act
