(‘‘CPSA’’) as amended by section 102(a)

Public Law 110–314. Specifically, the

requirements of paragraphs 14(a)(1), (2),0 |# R& t' c+ M
and (3) that otherwise require testing

compliance by manufacturers, including
1 M! j- ?6 p9 t7 simporters, of products subject to an

other Act enforced by the Commission.

with the exception of:9 W( l6 B$ M4 Y/ t) H H
(1) Those where testing and3 }: m, K1 P. X3 e2 l
certification was required by subsection
! n% g4 A; m( s# o14(a) of the CPSA prior to enactment of& I/ i! v6 v6 n, ~
the CPSIA; and5 B `, \- z6 f9 S8 ]
(2) Those requirements, when they1 e8 ~. |) [3 @. C
become effective, applicable to& ?/ |) I4 `! K- ~
children’s product certifications
! S4 M. Q, T9 d( `4 B* B( Arequired to be supported by third party
0 b' C! o# Q, t! K: V% C: K" vtesting for which the Commission has
- Q' s. p6 X! Y7 n# nissued requirements for acceptance of
# @2 U/ r; z5 e7 Y2 Maccreditation of third party testing" Q; s5 A7 ?1 y
laboratories to test for:
# _$ p' @5 [' m3 n• Lead paint (effective for products
$ x! _ ?' \8 g: \1 [manufactured after December 21, 2008),; l! d/ ?: Y- L: v
• Full-size and non-full size cribs and
- F7 o. q9 W0 q+ ^pacifiers (effective for products- w$ @# I: i* L' e7 p$ h% r$ j' s
manufactured after January 20, 2009),- t, p1 g4 ~8 k
• Small parts (effective for products+ Q2 ?$ f7 U# S) k8 I1 L
manufactured after February 15, 2009),, O: p; k6 s0 N* l8 @/ M
and
3 _! G& ?( f1 ?: {* S. V! @; t• Metal components of children’s
: L C0 J$ O, z, H2 Vmetal jewelry (effective for products
: ?$ |+ R- T+ _3 N! nmanufactured after March 23, 2009);

(3) Any and all certifications
' u" Q5 R& X! d6 U- @% z5 Vexpressly required by CPSC regulations;) Q5 B: D- W T+ I' F
and: z( h- U3 ^; r
(4) The certifications required due to j `/ r' K, @3 g- H* p2 q! @9 \3 S
certain requirements of the Virginia+ _! E' N$ m) D; ^
Graeme Baker Pool & Spa Safety Act! L) `, ]9 `5 B: C' I
being defined as consumer product/ n, o) N5 e m
safety ‘‘rules;’’ and
; S" }7 T6 E9 ], d) P& z$ o/ A; ~(5) The certifications of compliance
* x1 G7 p" t+ \5 @9 f8 trequired for ATVs in section 42(a)(2) of
+ @" I0 n4 R6 qthe CPSA which were added by CPSIA;
8 L- \/ B, y+ h! o1 x* g) B4 Cand: b/ K( m) y: m$ {7 C
(6) Any voluntary guarantees* v& Y+ D) n* S8 a: P7 E4 \8 w
provided for in the Flammable Fabrics
P6 T( F1 j. F4 Q/ g# gAct (‘‘FFA’’) or otherwise (to the extent0 ?* O# S! M0 O& h# Y& E& I
a guarantor wishes to issue one).
6 f9 k/ s: B5 M6 `( KThis stay will remain in effect until
, Q0 ?" U8 P+ r, j& w9 |February 10, 2010, at which time the
- y& r! R) j+ L4 h: ?Commission will vote to terminate the4 A% b1 p+ c9 U9 b; r
stay. This stay does not alter or7 i; z# \. H Q+ q
postpone the requirement that all. w4 v" ?- T0 n4 U! X8 [' f) l
products meet applicable consumer; ]! w, B1 H0 C* D1 u
product safety rules as defined in the
