certain provisions of subsection 14(a) of

(‘‘CPSA’’) as amended by section 102(a)4 H X; \* a& p: j3 V$ I8 @! P" ]
of the Consumer Product Safety1 E3 z; j& I8 {0 q+ g
Improvement Act of 2008 (‘‘CPSIA’’),
& v0 c) Q8 {% E$ }Public Law 110–314. Specifically, the
. ~- p7 g* m d" V/ e! B- H6 k$ MCommission is staying certain of the
1 i# @4 _1 Y& k( k$ s8 f; W& Krequirements of paragraphs 14(a)(1), (2),! H, S" }) i3 Q8 Y+ R
and (3) that otherwise require testing" R+ Z9 d5 e! ]5 e' g3 c
and issuance of certificates of3 U9 O+ L: y4 `8 @! r2 {5 u
compliance by manufacturers, including; I& t' S. d+ i! W( a8 w
importers, of products subject to an
* C2 _7 O F. Rapplicable consumer product safety rule
2 [$ n. F( c" W% G8 X' R0 fas defined in the CPSA or similar rule,$ g! A3 `2 i7 I
ban, standard, or regulation under any/ `+ ]; I: e: `) p( I, [) R+ Z4 E

This stay covers all such requirements
: I! }/ M" S0 V1 ~) pwith the exception of:. O+ j; Y% ~4 |2 F
(1) Those where testing and6 v) A$ P c$ j: s6 @
certification was required by subsection% k4 s8 ~5 \& f) L
14(a) of the CPSA prior to enactment of8 w, S) i. ^, _3 T% v8 N6 [, i
the CPSIA; and
% G/ r$ m; C+ b: ?2 B$ g& i(2) Those requirements, when they
+ d+ ^/ @: E. _& X5 b* @0 wbecome effective, applicable to( Q7 K# \) c. ?9 i* X! i; L
children’s product certifications. d4 B! ^$ \* `( @2 P
required to be supported by third party2 W% A/ ?& U7 J5 X& w2 G' _+ _0 t
testing for which the Commission has
: T6 J% q A: Y1 H y* O/ \* Hissued requirements for acceptance of

laboratories to test for:

, q- M9 c7 x: c: V5 fmanufactured after December 21, 2008),* @+ ?( S3 u. L5 c% z7 w
• Full-size and non-full size cribs and
$ o2 _; h: ~" Epacifiers (effective for products
, n/ U6 N2 w8 g, I4 Qmanufactured after January 20, 2009),
4 m! h4 T* Z2 W* W/ u/ K7 C) E• Small parts (effective for products
* [ U6 V7 _9 Rmanufactured after February 15, 2009),
, S- h. V8 e# _and
! c$ u& o) D+ ?: L/ r$ \# z• Metal components of children’s
& i8 D# K g& dmetal jewelry (effective for products. \( K# k4 H- ^1 N1 j4 p( `
manufactured after March 23, 2009);
' @4 t) d! `! X* q" ~and
' r% o% Z4 T/ D" O# t(3) Any and all certifications" v7 B8 a* e; l( [: ~
expressly required by CPSC regulations;
- R3 `2 Y$ K ^/ P2 Band, N& d% r$ p: H7 X* p
(4) The certifications required due to9 A7 {' N( C/ D3 Q4 g
certain requirements of the Virginia/ X2 v0 Q* L/ ] Y+ Q: f1 N
Graeme Baker Pool & Spa Safety Act# m F" I0 i* v5 j. F; z0 w* \3 g
being defined as consumer product
# ^( i$ V( X9 K8 J& `# L) ?safety ‘‘rules;’’ and
3 R, T8 x) Y+ r O3 e$ p3 ~(5) The certifications of compliance
" Q0 v: y `4 Y6 {+ h# U% zrequired for ATVs in section 42(a)(2) of
9 O# a) B+ s S d* D6 F: C) F2 V4 f- Pthe CPSA which were added by CPSIA;
/ Q+ H0 D: p* M4 G. B: C" vand) ^! x) O" p3 N, N5 b& i
(6) Any voluntary guarantees
6 o8 [4 `4 H5 A7 B9 @7 pprovided for in the Flammable Fabrics& g" `+ g* M% M( Q# o
Act (‘‘FFA’’) or otherwise (to the extent y' e/ S$ w8 P7 B, }8 x- }
a guarantor wishes to issue one).
3 E3 F9 L6 W* F/ DThis stay will remain in effect until/ D: |. R6 v) Y
February 10, 2010, at which time the
% t( t7 \4 G# x$ b9 vCommission will vote to terminate the
9 K0 c! Y9 ?! n2 Qstay. This stay does not alter or
# p4 Q- K1 S+ o/ I5 gpostpone the requirement that all( S9 l, j, d( Q$ ^
products meet applicable consumer
1 }1 a7 d& ^- u( W) Fproduct safety rules as defined in the! M f) D+ u) g
CPSA or similar rules, bans, standards,
