‘‘Commission’’) to stay enforcement of

the Consumer Product Safety Act

of the Consumer Product Safety& j3 u/ V4 t: `
Improvement Act of 2008 (‘‘CPSIA’’),4 q, _ R) L l8 k
Public Law 110–314. Specifically, the
' ]$ O3 o' I0 Z$ r$ YCommission is staying certain of the
% m1 W2 T$ o8 q' `; e8 @5 B; g" Qrequirements of paragraphs 14(a)(1), (2),6 m6 r6 t4 Z7 r2 Z ~! j0 N
and (3) that otherwise require testing0 M7 g3 Y9 `4 m0 C+ q
and issuance of certificates of4 V9 ]) g# X% L. q Y9 K
compliance by manufacturers, including
0 A" W, z# y$ F% N E. Aimporters, of products subject to an, [( L; a7 l, m1 S! Q
applicable consumer product safety rule
4 f \' P W, W4 e6 P, tas defined in the CPSA or similar rule,
* `" ^8 V% @) t E6 L' z8 oban, standard, or regulation under any6 n1 c0 o+ \7 ]+ N9 o' f
other Act enforced by the Commission.
/ { @2 c* D$ Z0 gThis stay covers all such requirements
. n6 L2 S' C. ` k1 t' xwith the exception of:
6 k: y" ~" u6 l& q0 @( k* _(1) Those where testing and) q2 m" T) J" j$ w7 S& ]# d4 H
certification was required by subsection8 G5 c F( G- X& Q3 u9 q i' i! e
14(a) of the CPSA prior to enactment of( z/ ?' M( ~2 \, l
the CPSIA; and6 e+ a ?4 a) U" z/ L* K, N% R
(2) Those requirements, when they

required to be supported by third party

issued requirements for acceptance of

pacifiers (effective for products
- ]2 x' e( _( H' k6 j/ H6 R3 k# T% K( Qmanufactured after January 20, 2009),

• Metal components of children’s% _, t% U. {8 W# ^* ^: ?
metal jewelry (effective for products

(3) Any and all certifications
$ m% M. E4 q" L2 S% `expressly required by CPSC regulations;

certain requirements of the Virginia3 g# H9 d% E0 M! c$ @
Graeme Baker Pool & Spa Safety Act

safety ‘‘rules;’’ and( B1 s7 ]5 V8 @; U
(5) The certifications of compliance

Act (‘‘FFA’’) or otherwise (to the extent

7 t+ `: x/ L9 S$ {, ?! `5 PThis stay will remain in effect until
! }) \" v( g2 y* ~+ _2 u7 w, N8 `February 10, 2010, at which time the
+ x. P) b8 _* F7 [Commission will vote to terminate the7 a5 A6 t, z- V- {5 ]
stay. This stay does not alter or6 [3 z% @; U- f5 A& r) s
postpone the requirement that all
