Improvement Act of 2008 (‘‘CPSIA’’),

Commission is staying certain of the
: t. Y$ Q2 L+ z: Trequirements of paragraphs 14(a)(1), (2),
, A9 F! r( p0 k$ F! c+ Vand (3) that otherwise require testing
! a' V5 Y1 P1 pand issuance of certificates of
& z& C( X X( Kcompliance by manufacturers, including
# Y! a5 t0 {1 y( Y9 L2 Kimporters, of products subject to an! p: S T7 x7 s) u: S+ R
applicable consumer product safety rule
6 I, z, q% Z @6 S5 Q5 h& Z$ uas defined in the CPSA or similar rule,
$ ~" `% x8 D% |$ ?; Sban, standard, or regulation under any
) a ~, Z& q; C$ X6 N) l* Wother Act enforced by the Commission. t, @4 X1 J2 x" o; s- ]
This stay covers all such requirements
. Y4 p" C8 D9 K& t8 l2 i* qwith the exception of:) ]+ Z( i7 r `* n9 x/ [/ S8 z
(1) Those where testing and% o: s. e1 P8 C; B
certification was required by subsection
) K% g/ e1 y( E" B& R" f14(a) of the CPSA prior to enactment of, v3 j& y5 a2 X+ z, ^5 _7 [
the CPSIA; and
+ R- I. B* B$ J- @' o(2) Those requirements, when they
( z$ O, O: j, z9 e% _become effective, applicable to9 k8 G8 K/ d) j3 o0 @; h6 k

issued requirements for acceptance of

• Lead paint (effective for products3 ]( ?/ G: @/ j0 E# D
manufactured after December 21, 2008),
/ K0 h9 E5 K; A' D. C* C: r• Full-size and non-full size cribs and7 H3 O) H# A: I) [) T4 Y
pacifiers (effective for products' O: W5 u4 C7 W' H; c: J
manufactured after January 20, 2009),8 r7 A- p) S7 C6 W
• Small parts (effective for products
# A! Q5 F M/ N* Gmanufactured after February 15, 2009),
+ y+ e( W) j4 [1 n( @4 i9 Oand# E/ N: ?$ M, i p
• Metal components of children’s$ k- }9 F$ ?4 @( g3 V( L
metal jewelry (effective for products
1 j0 A) d u! \) K: Imanufactured after March 23, 2009);/ r! T3 s: O, h! P

(3) Any and all certifications
2 Y) C1 K4 j; z. v8 L/ O3 Pexpressly required by CPSC regulations;! f( I2 H) l! s
and
5 R; T- r. j; g y# o(4) The certifications required due to
8 c/ `6 T4 S# M Q9 Icertain requirements of the Virginia; c% C8 s q1 n2 t' d! h% o$ t; V
Graeme Baker Pool & Spa Safety Act
- ]0 o5 V8 r3 F. _9 ^8 s' M* [being defined as consumer product; l, {5 Y& t' E& ]: Z$ h& @. e
safety ‘‘rules;’’ and
9 L/ ~" E: d W3 D9 _! V- m(5) The certifications of compliance7 i$ A. w0 L$ B4 o) T6 ]4 \
required for ATVs in section 42(a)(2) of4 x5 i3 N( q* k$ C- q; F
the CPSA which were added by CPSIA;

(6) Any voluntary guarantees
- Q; O' x" }) dprovided for in the Flammable Fabrics
6 r$ |! E4 A+ O( i) u! oAct (‘‘FFA’’) or otherwise (to the extent
; z8 q( e0 i6 ?; b5 G& X$ C% {a guarantor wishes to issue one).
7 J9 ~% F5 _# r* m7 `3 K: r4 `0 LThis stay will remain in effect until) U; D8 C, e" Y- {. H6 {6 h
February 10, 2010, at which time the
Q- m) T; q$ _1 zCommission will vote to terminate the) I$ J! V7 p' s& I3 ^* W E9 k
stay. This stay does not alter or k0 W" f5 ]. |- d9 q) g8 p
postpone the requirement that all4 h3 Z/ X3 E) x
products meet applicable consumer
$ @% q. ]0 R3 |# G# fproduct safety rules as defined in the, N/ u) `" B) K6 I% O0 X7 \9 g
