This notice announces the

Safety Commission (‘‘CPSC’’ or
& Z6 P; ?5 d$ z! J9 G‘‘Commission’’) to stay enforcement of
0 I8 w+ H& w, N, W( b: lcertain provisions of subsection 14(a) of
$ A$ T. s7 k- P# Z, o& D$ K; Othe Consumer Product Safety Act, ^6 P0 F' u/ U% p$ G
(‘‘CPSA’’) as amended by section 102(a)2 g$ J1 V* v/ E* u1 e
of the Consumer Product Safety6 |) E1 [0 O5 W$ E% L# K
Improvement Act of 2008 (‘‘CPSIA’’),
* H& L8 a" ^2 m3 ^! G ~& \0 \Public Law 110–314. Specifically, the
7 S% U! F3 L0 g$ t8 s' KCommission is staying certain of the! j( N5 X. T+ T0 Z; n
requirements of paragraphs 14(a)(1), (2),
3 [% T1 Q2 c2 ~* ~and (3) that otherwise require testing$ e% p8 ^, Y9 \/ k' ^
and issuance of certificates of7 r- D0 Z7 p, a8 }
compliance by manufacturers, including' h7 y$ e* ^0 ~6 S
importers, of products subject to an# O! l9 e: K* v e6 \2 J( s* F/ @
applicable consumer product safety rule
5 Q4 S, k7 T0 ^. u. p9 |' B" k! Gas defined in the CPSA or similar rule,2 d. x( w9 O: L6 K
ban, standard, or regulation under any* g- N3 P" J; E; f
other Act enforced by the Commission.
5 Y; z" \' s: K$ G. jThis stay covers all such requirements7 a) `) y# o7 K- ?3 S) } T
with the exception of:
/ g" M9 E' `9 B6 c(1) Those where testing and
% \; h4 K( C; O2 ^2 f9 {2 ]certification was required by subsection
* b2 [/ O, c3 h6 e2 G/ y14(a) of the CPSA prior to enactment of. j* T5 j: y* Z3 c/ q' ~/ x0 D
the CPSIA; and! X. Y" J1 w6 Y* I5 ~# o
(2) Those requirements, when they; b. K1 c) V& n& Y6 E) L4 ]
become effective, applicable to
2 N' W; o, O& r% achildren’s product certifications
5 _6 b" z$ M7 j R- i$ \required to be supported by third party: `) [+ D6 z! M( ]
testing for which the Commission has
; p0 _) C1 Y# R$ Kissued requirements for acceptance of
9 l, |; Y+ U3 v0 naccreditation of third party testing
3 ?9 b o) J4 w! Flaboratories to test for:
; O6 ]) i: `3 N. o" ]/ g. E9 K• Lead paint (effective for products6 g' F% Y: w; f4 a! j
manufactured after December 21, 2008),
% j- j2 Z7 z1 b# n7 z' l" J• Full-size and non-full size cribs and8 F' ?1 u& F. } `0 ~% Q
pacifiers (effective for products* S7 J% @9 X: C3 W6 q4 L
manufactured after January 20, 2009),
4 r( F. K: p* O2 J0 A6 c• Small parts (effective for products. W6 i% v# D" I3 V
manufactured after February 15, 2009),# j+ i3 p' {3 G! N
and
: `: x& e5 I0 T( t; e• Metal components of children’s
4 n, I) l" A( g3 z/ M. fmetal jewelry (effective for products* E$ k, N/ _) v! K, d
manufactured after March 23, 2009);; o# ^( @! i* Q, Y5 u3 B' m; l' d
and
! A ~( H4 H! W( E+ ~9 v(3) Any and all certifications
+ U6 G- Q# j8 `$ F5 Vexpressly required by CPSC regulations;
0 F6 `- p# z& Z6 J6 T) band
1 \9 D) E" s8 ~5 Y(4) The certifications required due to
4 L4 R) w( K8 ]+ F7 \1 J* j; W* Hcertain requirements of the Virginia
1 W% P+ Z& ~& o/ M! C* eGraeme Baker Pool & Spa Safety Act+ d" S/ ^2 d4 k1 I% W
being defined as consumer product
/ }% H j- a! o2 Dsafety ‘‘rules;’’ and3 b9 K4 ^ y1 y" K2 N$ |
(5) The certifications of compliance
* D9 i( o9 L3 b6 f7 \required for ATVs in section 42(a)(2) of
8 a& R# p/ u( S" R+ | W0 Zthe CPSA which were added by CPSIA;7 o$ n5 B+ o1 d }7 t
and
, b6 J% a: m2 B$ W0 ?4 h(6) Any voluntary guarantees
. ?8 |! [6 q1 P" w. m( fprovided for in the Flammable Fabrics* K/ M% B1 ?7 s' U3 v
Act (‘‘FFA’’) or otherwise (to the extent- L( z4 n5 c# g5 T9 f
a guarantor wishes to issue one)., ^# O) E+ F) v6 Z# d1 g+ Y
This stay will remain in effect until: E! t' [: H+ P& D3 @& U
February 10, 2010, at which time the: ]5 J. ]6 H9 d4 B# N# N5 @7 `
Commission will vote to terminate the& f/ z1 l1 m0 O# v+ ~1 ~6 j3 [& u
stay. This stay does not alter or, _/ H% r7 W% C8 ]
postpone the requirement that all
# k8 I+ b4 q `! H+ Jproducts meet applicable consumer
& M3 o5 z1 D3 D d3 {8 x% N! Xproduct safety rules as defined in the
7 c$ J, f5 r: R4 ]: |2 aCPSA or similar rules, bans, standards,
3 M" T" b) f% G8 Ior regulations under any other Act
5 [( Q4 g( g# G5 K. x. z) t4 cenforced by the Commission.
