certain provisions of subsection 14(a) of

Commission is staying certain of the9 Z G& A+ s. |2 D6 X
requirements of paragraphs 14(a)(1), (2),( U6 S+ [. t" Z% }+ T9 w! o3 N1 _) I
and (3) that otherwise require testing' Z1 m* z( m; V0 f
and issuance of certificates of
2 {) K; S; W. ~3 _5 wcompliance by manufacturers, including' Y. c3 U; C- J& L1 x3 X+ F d' m3 I
importers, of products subject to an
6 W2 W& Y8 ?9 n3 J( H- tapplicable consumer product safety rule
0 y$ o; R" m6 Zas defined in the CPSA or similar rule,
5 Q! k. h9 j5 k& m( Z7 wban, standard, or regulation under any. v' @# r3 Q$ e6 g
other Act enforced by the Commission.
+ G# O5 y0 f" {* wThis stay covers all such requirements) p0 L6 o8 W/ ^: u5 D& m% Q
with the exception of: h: K" M+ ]* H3 H0 X
(1) Those where testing and* w8 p6 E9 H! X' G1 a
certification was required by subsection! O/ `1 i; ` N$ S/ w
14(a) of the CPSA prior to enactment of- }/ {& R0 p7 i' J. O
the CPSIA; and
) f7 X6 u+ h% a2 o3 B(2) Those requirements, when they* S) X3 p8 h; Z
become effective, applicable to
7 q2 N/ x% Z; W" c* [2 Uchildren’s product certifications
, R! P- M- C6 r. e' }* mrequired to be supported by third party
5 J/ L2 w; s" F9 Ktesting for which the Commission has4 A# y4 U) W- C% `
issued requirements for acceptance of: x5 s, i% s& u
accreditation of third party testing
4 j) c: C: H+ [* Q3 I, I2 Ulaboratories to test for:& O, N! w. x' f
• Lead paint (effective for products% N5 L% D8 h8 I; L7 F! ?7 ?/ w
manufactured after December 21, 2008),9 D6 e& S( D/ t* I0 S, i, l% u
• Full-size and non-full size cribs and) ~$ L5 f d8 z- e2 T
pacifiers (effective for products
; R4 Q; s1 i& ^manufactured after January 20, 2009),
) c/ n$ H# g5 R5 z5 ^• Small parts (effective for products7 P7 R- E' U- c& |
manufactured after February 15, 2009),4 y' V/ r* _6 i* d3 W
and
8 R1 J9 G; c8 C3 l% u P• Metal components of children’s
; D$ p- U R4 O9 S2 l9 d" bmetal jewelry (effective for products
6 [0 s$ N( G$ @4 G) v8 C! kmanufactured after March 23, 2009);
' V+ ?/ Y# B/ ^( O4 @and+ y- n+ p0 T' t! v# z. A
(3) Any and all certifications V9 Q+ u0 u9 m: \* e; K6 H
expressly required by CPSC regulations;
4 r* {$ V" K/ R1 _' Aand$ r% P V) L5 K/ G! i6 z3 q3 V
(4) The certifications required due to
/ r5 D: Y8 I( T" Scertain requirements of the Virginia
/ O# g. s% }& Q9 v6 cGraeme Baker Pool & Spa Safety Act
J+ C1 Q2 y" H* c6 P/ q& rbeing defined as consumer product7 e+ N7 `0 Y7 S2 m
safety ‘‘rules;’’ and
* T* [- _) I3 Q/ }(5) The certifications of compliance3 {: r! Z, a# Z8 h: H
required for ATVs in section 42(a)(2) of4 ]1 E! l& F' L1 r! C4 w
the CPSA which were added by CPSIA;# r: l- B, J$ `, ?3 J
and
+ O% c3 `0 c/ f(6) Any voluntary guarantees
5 P7 s" E: K* q+ j) |provided for in the Flammable Fabrics1 Q; e# G$ k- ]) |! p @! X
Act (‘‘FFA’’) or otherwise (to the extent" H, p5 {$ @& y' E a9 b ~
a guarantor wishes to issue one).2 S: y T9 z/ N. r* {
This stay will remain in effect until
$ c! B0 [, ^5 q$ JFebruary 10, 2010, at which time the
; R% M4 q' h7 u' v) Z* ICommission will vote to terminate the2 e7 ]3 D9 {: ^% s7 T
stay. This stay does not alter or6 s1 W8 d7 t) n7 ~( n" t: X/ H; h( U! [
postpone the requirement that all S& m6 ~7 r# x& r
products meet applicable consumer% z$ O$ o6 U8 }, |9 G5 [! `2 Y* q5 x
product safety rules as defined in the
+ l! i# ?/ Z9 l; I' i: f" P) RCPSA or similar rules, bans, standards,' L' K+ f9 f& @* D$ e
or regulations under any other Act! _/ l: I9 c: n3 P2 z. ^
enforced by the Commission.

effective February 10, 2009.1
