This notice announces the

Safety Commission (‘‘CPSC’’ or

: i4 w- v; c. L2 d1 [* Vcertain provisions of subsection 14(a) of
9 p$ Z. X5 B+ M' z7 F# }* v& c( Ithe Consumer Product Safety Act
1 a/ {+ w3 r( b7 |# P(‘‘CPSA’’) as amended by section 102(a)
- s G( k3 k3 S+ H9 ]9 _of the Consumer Product Safety
& ~# B+ m& d' z z( T% \% RImprovement Act of 2008 (‘‘CPSIA’’),0 k4 |$ g Q2 E7 X2 Q5 X
Public Law 110–314. Specifically, the2 x |5 z8 z; e3 y! Z
Commission is staying certain of the
& @% Z1 `% ~# l% B5 v# j& L4 P, vrequirements of paragraphs 14(a)(1), (2),% w9 R/ T% R8 }' @9 z
and (3) that otherwise require testing; X2 ^2 O# @1 d0 Y5 K" {
and issuance of certificates of
2 r- w/ L( U# D# ~+ rcompliance by manufacturers, including
3 D j- q/ z" a4 z6 j& oimporters, of products subject to an$ y/ ]- X, D1 c/ \: u, y0 H; l
applicable consumer product safety rule) j r0 {/ a8 z: m
as defined in the CPSA or similar rule,7 k7 M- e2 ]3 ?. H
ban, standard, or regulation under any
8 o6 F) o8 t6 aother Act enforced by the Commission.+ @0 P/ {0 D* _/ \
This stay covers all such requirements' t# f& K5 F4 M$ l( l% h
with the exception of:$ g4 v* r0 c. t2 B
(1) Those where testing and
. i! h7 u; g# N7 l! Q, C, ^; ~3 q$ `certification was required by subsection
$ Q8 _* `8 m9 d# j$ Q% ? p14(a) of the CPSA prior to enactment of0 C- ^3 F3 H) D+ K: ~" h
the CPSIA; and
9 X T0 e! R! N+ @/ z8 d(2) Those requirements, when they
* f' X. Y) X2 G$ ~become effective, applicable to
/ N' F' K0 `% rchildren’s product certifications% Q1 [3 u! w1 I- [
required to be supported by third party* z* @$ p! {9 [2 H- ^) A
testing for which the Commission has
- J0 a n. s3 y! l t2 D; Vissued requirements for acceptance of
F3 }, a. Y" Q3 eaccreditation of third party testing
2 v, x2 f0 @$ claboratories to test for:
; B: q c* k! g/ c! k• Lead paint (effective for products7 h- ~9 K' ?2 K" q% t0 O& w/ s6 o
manufactured after December 21, 2008),5 @* f- W7 A1 p" Q5 p6 J8 z" f: b
• Full-size and non-full size cribs and- E' b# _5 y, d2 H) [# J9 @5 D
pacifiers (effective for products, s* B4 }1 z) d2 V
manufactured after January 20, 2009),: X+ s: ?6 q& M; Z' ]% ^
• Small parts (effective for products; W7 a- {+ z. h; S, y
manufactured after February 15, 2009),* G3 |5 v# n" d! g# ~& h
and5 Z1 h- V+ n4 r5 k6 I6 M
• Metal components of children’s& K3 S3 s/ k2 {3 t/ Q
metal jewelry (effective for products: u h+ w& ~4 u* v$ H( v( u
manufactured after March 23, 2009);
. e9 v/ {. ?0 Z. \: C# A7 o8 @( T( Zand
, C5 p" e C) f/ o0 Z+ U(3) Any and all certifications& D' L: [9 D; b5 C
expressly required by CPSC regulations;
) O$ Y6 G% @7 l! N- K1 |) X* nand$ J3 [1 a7 @& m4 u/ Z+ I8 I
(4) The certifications required due to0 I% R2 g# n+ m8 K: N" f0 a
certain requirements of the Virginia
1 u6 ]. y( o K/ mGraeme Baker Pool & Spa Safety Act
' P" i- E# O+ P- {6 p5 ybeing defined as consumer product
' x3 I+ e6 l3 [" psafety ‘‘rules;’’ and
3 M; I0 N4 d! \& _(5) The certifications of compliance
9 `# P1 J7 p1 j& A. h) _3 W( }$ l Jrequired for ATVs in section 42(a)(2) of) ^+ W* \/ z# T8 I o9 W6 X5 K
the CPSA which were added by CPSIA;7 d, q6 X5 w1 l+ h
and
- h1 S r. d$ c1 G(6) Any voluntary guarantees6 g7 W" R& F7 | y% \
provided for in the Flammable Fabrics
3 \3 V) q& W3 u+ Q1 m8 m: e" C/ E# oAct (‘‘FFA’’) or otherwise (to the extent
5 D, Z$ {9 n& @' V( aa guarantor wishes to issue one).
% V3 y0 e9 d s/ ~/ tThis stay will remain in effect until
7 q4 @1 x- {; _% \! b/ `February 10, 2010, at which time the
_8 g: f# c2 M( g$ q, i! o# OCommission will vote to terminate the
' X7 Z9 ]- V. w Tstay. This stay does not alter or# v$ A, I5 U( A0 c" J5 ^
postpone the requirement that all% m/ v0 J* t% H1 s# f7 l
products meet applicable consumer* @# D, q/ m9 q, w
product safety rules as defined in the0 l, x6 x/ f6 _1 O: V- `
CPSA or similar rules, bans, standards,
6 o+ q/ `6 m+ m/ yor regulations under any other Act$ @$ ` [5 t/ `& X: c
enforced by the Commission.
