of the Consumer Product Safety

Public Law 110–314. Specifically, the
. c6 I% K/ T$ s2 ^) t- {9 _- E! aCommission is staying certain of the" {: Y9 g. W/ ^7 s
requirements of paragraphs 14(a)(1), (2),
# f2 F2 J+ o& l eand (3) that otherwise require testing
% b: m' U9 z' B5 P( mand issuance of certificates of; W0 z! Y4 V7 Z4 g
compliance by manufacturers, including8 U6 @# t& C' T5 D: T
importers, of products subject to an7 [' P+ M$ v! ?! A5 C$ p3 \0 J
applicable consumer product safety rule& ?. f5 i! u: G% ]# H
as defined in the CPSA or similar rule,3 Q) Y. n% ^( E" }* M- }% u: d
ban, standard, or regulation under any1 [0 T+ I* p( f1 w
other Act enforced by the Commission.. j3 W/ _- c, r* w+ Y, u0 e. Q% }' r# }
This stay covers all such requirements
4 V, q3 U4 u5 {; U1 }with the exception of:
- O8 Y1 E; |! q) G \. q7 d(1) Those where testing and$ q9 A% @: H: _! P; h' p0 h! m
certification was required by subsection- D8 ?$ c$ ~+ O' Z
14(a) of the CPSA prior to enactment of5 k: h$ y& H. d0 t
the CPSIA; and" `5 R; }9 E- \- W2 H
(2) Those requirements, when they

issued requirements for acceptance of

• Lead paint (effective for products& B; M; O) e0 C& r9 g0 E
manufactured after December 21, 2008),# a) T; b! J0 ~) m
• Full-size and non-full size cribs and3 p" m) X, U# D
pacifiers (effective for products
& l1 v7 J# H- K; V! f4 b% Qmanufactured after January 20, 2009),
: J0 H# D5 Q! ~• Small parts (effective for products
: h+ t/ s3 _' d7 s; [+ zmanufactured after February 15, 2009),

• Metal components of children’s
+ Z$ @ p$ v" `# e. {metal jewelry (effective for products5 w" p' i+ n3 N r" C2 k
manufactured after March 23, 2009);

% m$ H2 }: S9 I5 h/ E2 f1 x(3) Any and all certifications
: J! b$ v5 S+ c" hexpressly required by CPSC regulations;

( B. J/ Z" a/ m" d# d+ g( H7 s) ]* h) Ucertain requirements of the Virginia, R/ c1 W. h( X) C' A- ^
Graeme Baker Pool & Spa Safety Act2 t# }8 }" V! w( a1 R# V) n0 l
being defined as consumer product3 l( O4 |, A }
safety ‘‘rules;’’ and1 U0 w! Y5 F# J- k* ?
(5) The certifications of compliance
; L' ^) |) d) qrequired for ATVs in section 42(a)(2) of
. ]6 V: `0 y8 j* s/ @; T* e7 ethe CPSA which were added by CPSIA;
: z/ g. p5 }' Z. H/ fand
2 r* d* B b% Y(6) Any voluntary guarantees8 v% h0 D! L: I
provided for in the Flammable Fabrics
9 J9 L3 C& j$ E0 {) Y5 @: ?Act (‘‘FFA’’) or otherwise (to the extent' }- p/ K1 `% G9 {0 ]
a guarantor wishes to issue one).# i1 l2 C b/ J3 v* i8 _
This stay will remain in effect until1 {- E' y- s" m7 v6 x
February 10, 2010, at which time the
9 X. Y5 P0 c- N; }. FCommission will vote to terminate the
1 t, J- @* X- a0 }& x2 W9 ]8 R4 W7 ~. Vstay. This stay does not alter or* C+ N9 b# A/ [# k% d
postpone the requirement that all v" Y* G: I5 A6 U4 X1 {1 w
products meet applicable consumer
1 K4 m* B" g4 M% p% X4 ^product safety rules as defined in the2 y# d& o$ T; w8 z5 C! \/ A0 D
CPSA or similar rules, bans, standards,
