decision of the Consumer Product

' s0 u: W- s6 X& y/ K1 c4 T/ u. gcertain provisions of subsection 14(a) of2 \; L" x/ I0 c' f- N
the Consumer Product Safety Act
: p4 s. @! r4 l1 {(‘‘CPSA’’) as amended by section 102(a)
) c7 Q+ ]' I- z1 Y$ }) _of the Consumer Product Safety: R7 b1 w& \6 [- m, J
Improvement Act of 2008 (‘‘CPSIA’’),' o( |% z t2 }; ^
Public Law 110–314. Specifically, the
2 ]5 g2 e P+ l$ `/ u- {4 y3 u- K3 _$ gCommission is staying certain of the+ @. s4 a# F9 P0 D. [5 V
requirements of paragraphs 14(a)(1), (2),
- Q+ t2 l( l# Eand (3) that otherwise require testing
) Y9 S- O6 i1 n+ }and issuance of certificates of6 w( c* H) `" j u
compliance by manufacturers, including
/ |3 @* c$ Q7 U+ N9 \importers, of products subject to an2 y* p1 Z- `3 U7 R
applicable consumer product safety rule' {3 S* u. i& N$ B) y# w- o; `+ X" j
as defined in the CPSA or similar rule,( k" G# h2 E- I. K
ban, standard, or regulation under any( _ Y' G% O8 t' b. _
other Act enforced by the Commission.
3 r5 m6 q6 H) @0 ?# ^# Y% p$ iThis stay covers all such requirements! V" v8 m# \) C6 C3 x; k0 x* J
with the exception of:# @' D/ {' H! c+ }
(1) Those where testing and
8 v3 z8 {4 x/ h1 X" F& y8 _certification was required by subsection
z) S# \9 o: t8 [* O14(a) of the CPSA prior to enactment of& \" V2 O8 a; q$ e6 q- m$ O% x, j* } b
the CPSIA; and z9 m4 |& P }( h# M6 h
(2) Those requirements, when they

required to be supported by third party

issued requirements for acceptance of( h _0 X7 N+ ]
accreditation of third party testing

• Lead paint (effective for products2 w3 o# {, v5 m! H! V1 b* V# \
manufactured after December 21, 2008),, o3 K/ u( p2 Z& o- ~ a
• Full-size and non-full size cribs and4 j5 l& g% J# C! B$ ]0 k
pacifiers (effective for products2 `1 h v/ m# h
manufactured after January 20, 2009),
5 b: A5 o V3 L& r! L$ F5 j z. M• Small parts (effective for products
% [6 ~0 A5 I1 l, _5 c) q- Imanufactured after February 15, 2009),
- B" s" `1 G' |' K! Sand
7 g+ ?- z; i$ Z9 Q• Metal components of children’s2 y. p' w q2 P# |% N( t, N9 [
metal jewelry (effective for products) ~' c6 p' p7 W! k. y( A% [& u
manufactured after March 23, 2009);. V& ]# z1 U, z$ p3 f
and
- u. w& x& S/ z* s) a* D- l# I$ k(3) Any and all certifications
. f5 I9 ?. I3 J- ^expressly required by CPSC regulations;

(4) The certifications required due to
* A: \" d! C' Z: n: Acertain requirements of the Virginia

# ]: R5 F! F3 k+ b1 @5 V; S/ g" H+ U* \being defined as consumer product
- d+ m# P3 m1 Fsafety ‘‘rules;’’ and2 D. `$ B0 P9 }9 ~5 U
(5) The certifications of compliance
3 }8 J8 v2 d% K& mrequired for ATVs in section 42(a)(2) of7 n2 W9 V: m; q3 S2 X0 ~. w) Q
the CPSA which were added by CPSIA;
/ I" B) ^$ j3 N6 f G! }7 E1 I0 Y2 Xand0 S$ ~$ f- m ?
(6) Any voluntary guarantees
+ i% n& L X7 T- I% iprovided for in the Flammable Fabrics
' ? {3 j+ G6 |3 [, {9 XAct (‘‘FFA’’) or otherwise (to the extent
4 B' T& `! J0 H& y( Z/ Ba guarantor wishes to issue one).1 j4 ]3 Y6 g- [0 D
This stay will remain in effect until
* }( b( V1 v' E: W" P2 F8 f$ I8 cFebruary 10, 2010, at which time the" H( n! d0 @2 k: C- N
Commission will vote to terminate the
) B Z' V3 h' d2 t' h! gstay. This stay does not alter or
4 J1 H0 a+ l' ^1 [8 C- h apostpone the requirement that all
. m4 O6 w5 b2 Z9 C7 n& h. A6 Kproducts meet applicable consumer
: ` ^6 H6 C! M8 G5 j: Yproduct safety rules as defined in the
7 ]( v. }0 V+ x- J. f. K J3 i0 DCPSA or similar rules, bans, standards,% o" Y3 b" M x
or regulations under any other Act

effective February 10, 2009.1
