The Consumer Product Safety Improvement Act of 2008 was legislated on 14 August 2008 that& c9 l J) N( L$ k+ c9 M& {$ Z6 J
regulates the manufacturing and testing of imported consumer goods in the US.
- g" V, v" }/ l& YThe new Consumer Product Safety Improvement Act, due to be in force by stages, requires
$ @) o% R' C& ?mandatory third-party testing of products intended for children aged 12 and under covering a) L7 T2 u9 o3 Y
broad spectrum of product categories, including toys, furniture, baby cribs, pacifiers, children’s
: O/ c) D+ n$ |4 z- wmetal jewellery, baby carriers, high chairs, strollers, walkers, swings and cradles./ C$ b6 }! @9 t6 h/ D* h
The Act will ban the sale of consumer products that contain excessive amount of following; \: d$ Q4 P* l& c/ M
substances by the respective effective dates:
9 e$ m' |5 D8 p, P- Total lead content by weight for any accessible part of children’s product through
2 e/ l% N/ j' q, wreasonably foreseeable use and abuse e.g. swallowing, mouthing, breaking, or other, t; e0 y3 s( j, c' H5 k$ g7 D
children’s activities, and the aging of the product:

- Lead in paint and surface coating in max concentration of 0.009% or, more than 2μg
9 y8 K! ?6 N- C% v! Nof lead in a total weight ≤ 10mg of paint or other surface coating or in a surface area ≤* R7 ]/ P5 j0 v: m$ I" e
1cm2 (beginning 14 August 2009);
- J% g7 {! {# J# X/ D! q. F% k0 g5 Z- Phthalates (DEHP, DBP or BBP) in concentrations exceeding 0.1% by weight of* K) Q. V( W' J
children’s toy or childcare article, or phthalates (DINP, DIDP or DnOP) in
, A9 b5 T; k% S$ U# r7 dconcentrations exceeding 0.1% by weight of children’s toy that can be placed in a7 | O$ s* x& [' G
child’s mouth or childcare article (beginning 10 February 2009).' B3 p7 T$ W% q
The Act also specifies ASTM F963-07 Consumer Safety Specifications for Toy Safety as8 J8 ^7 j7 q* }9 M$ y) C
mandatory standard under the Consumer Product Safety Act and demands rulemaking process for/ a6 }/ e9 _! U, i5 `
12 specified durable nursery products for use by children under the age of five years.
1 \4 Y+ V9 N# Z! j6 uThe Act further requires that children’s product and its packaging should come with a tracking& Y3 B3 h1 E# k2 W, D* o& Z5 z
label that allows officials to trace a product back to its factory in the event of a recall. Any
' R5 }& m9 u* c0 C0 Eadvertisement for direct marketing shall carry appropriate cautionary statement for product that% r2 ^, z$ G0 N$ d0 P: L& R
requires such information.
( T p6 h" j) U( l+ H2 r! hCivil penalties for violation of any CPSC regulations are increased from US$5,000 to6 u; S; ]0 e( F: [! T8 y
US$100,000 for individual violation or up to US$15 million for violations involving multiple
