The Consumer Product Safety Improvement Act of 2008 was legislated on 14 August 2008 that+ V8 I3 r% y$ i
regulates the manufacturing and testing of imported consumer goods in the US.3 d5 h" D% y# @7 S# A4 u
The new Consumer Product Safety Improvement Act, due to be in force by stages, requires& X) b# p) U2 _9 R% S
mandatory third-party testing of products intended for children aged 12 and under covering a$ X) [+ Q% t7 m
broad spectrum of product categories, including toys, furniture, baby cribs, pacifiers, children’s+ c% ?" P% t: d+ u R: K- V
metal jewellery, baby carriers, high chairs, strollers, walkers, swings and cradles.
9 I0 G2 }' V- Q1 D2 c+ ~" dThe Act will ban the sale of consumer products that contain excessive amount of following
: C4 E0 o: Y, hsubstances by the respective effective dates:
; N3 B" f2 q' o0 M! u* e. t9 F- Total lead content by weight for any accessible part of children’s product through/ q3 \& v4 i0 Y
reasonably foreseeable use and abuse e.g. swallowing, mouthing, breaking, or other$ H7 Z3 T! M6 w3 z7 w: C! q ~
children’s activities, and the aging of the product:# L" \0 Y1 c7 \+ N9 B& y
o more than 600ppm (beginning 10 February 2009);- |# t, M8 t0 @8 B5 m
o more than 300ppm (beginning 14 August 2009);
9 U4 V. f$ Y2 Uo more than 100ppm (beginning 14 August 2011);9 s( t6 y$ |; Q
- Lead in paint and surface coating in max concentration of 0.009% or, more than 2μg5 v: `" R' n7 T+ K, Y- C6 T
of lead in a total weight ≤ 10mg of paint or other surface coating or in a surface area ≤! S3 O$ T+ _1 v! {

concentrations exceeding 0.1% by weight of children’s toy that can be placed in a

The Act also specifies ASTM F963-07 Consumer Safety Specifications for Toy Safety as
2 ]9 q& h! o# H6 w# U$ m" U Z8 Imandatory standard under the Consumer Product Safety Act and demands rulemaking process for/ Q' h' e; w3 v8 O- C2 t
12 specified durable nursery products for use by children under the age of five years.$ B3 d; U! |0 o
The Act further requires that children’s product and its packaging should come with a tracking

advertisement for direct marketing shall carry appropriate cautionary statement for product that

Civil penalties for violation of any CPSC regulations are increased from US$5,000 to
