The Consumer Product Safety Improvement Act of 2008 was legislated on 14 August 2008 that6 m3 C. L# [7 ]
regulates the manufacturing and testing of imported consumer goods in the US.
3 o. z% c+ U* r, J" S! mThe new Consumer Product Safety Improvement Act, due to be in force by stages, requires" `4 Z$ ]7 l! f
mandatory third-party testing of products intended for children aged 12 and under covering a
9 @$ P# Z/ o6 }" D: ^) {broad spectrum of product categories, including toys, furniture, baby cribs, pacifiers, children’s) `: I/ W" q+ t4 K3 _
metal jewellery, baby carriers, high chairs, strollers, walkers, swings and cradles.9 s; A4 n. y" Z+ Q- C
The Act will ban the sale of consumer products that contain excessive amount of following2 F8 r' c. |1 O, l+ }
substances by the respective effective dates:8 V2 h, O2 A4 [2 t" g% {
- Total lead content by weight for any accessible part of children’s product through
5 q+ S$ C" f" J! c: \" ireasonably foreseeable use and abuse e.g. swallowing, mouthing, breaking, or other

5 ~; q. b! o9 qo more than 600ppm (beginning 10 February 2009);$ E3 X: F& W* W1 R9 q8 K
o more than 300ppm (beginning 14 August 2009);- w; ? I; @4 u+ x* x: D
o more than 100ppm (beginning 14 August 2011);
7 O- {" n3 u" v5 f* Z7 W- Lead in paint and surface coating in max concentration of 0.009% or, more than 2μg
& @+ N2 {' c, I" |% ~of lead in a total weight ≤ 10mg of paint or other surface coating or in a surface area ≤ _5 G% ?3 D+ Z6 l
1cm2 (beginning 14 August 2009);
& k5 w* s. a' H% L: _8 p- Phthalates (DEHP, DBP or BBP) in concentrations exceeding 0.1% by weight of8 p5 D% ]4 p# _1 v& f- u8 P
children’s toy or childcare article, or phthalates (DINP, DIDP or DnOP) in( F( t! U; R* o
concentrations exceeding 0.1% by weight of children’s toy that can be placed in a- X- | o6 q# t. P* ^
child’s mouth or childcare article (beginning 10 February 2009).5 Q1 h; X- u9 K, Z
The Act also specifies ASTM F963-07 Consumer Safety Specifications for Toy Safety as1 F, i) G; t) u* ?7 }3 x
mandatory standard under the Consumer Product Safety Act and demands rulemaking process for
2 K, z$ m. @+ Z0 D12 specified durable nursery products for use by children under the age of five years." [7 D, V' r9 S% x' `8 R
The Act further requires that children’s product and its packaging should come with a tracking
/ l9 {- f& V& f7 F. M- n3 b# ilabel that allows officials to trace a product back to its factory in the event of a recall. Any; ?. s$ H! U% p& n- k+ G: O: D5 ?
advertisement for direct marketing shall carry appropriate cautionary statement for product that
- N+ s1 `& S+ a9 r8 A' frequires such information.
- Q4 ]% U- T6 [5 eCivil penalties for violation of any CPSC regulations are increased from US$5,000 to
5 o0 c. L! y; m+ @/ `4 y, QUS$100,000 for individual violation or up to US$15 million for violations involving multiple
