The Consumer Product Safety Improvement Act of 2008 was legislated on 14 August 2008 that# i! S& q. p2 p" e. k- R; e
regulates the manufacturing and testing of imported consumer goods in the US.
: B& U2 P* H; s7 XThe new Consumer Product Safety Improvement Act, due to be in force by stages, requires
+ Y' C- O* |: lmandatory third-party testing of products intended for children aged 12 and under covering a4 v8 I" a+ E# C( x' l
broad spectrum of product categories, including toys, furniture, baby cribs, pacifiers, children’s3 r+ N, {$ e7 t& \2 q+ g. {" ]
metal jewellery, baby carriers, high chairs, strollers, walkers, swings and cradles.
# Q: z6 F$ ?7 [. n( L# xThe Act will ban the sale of consumer products that contain excessive amount of following+ G: j. D: V8 ^7 p- z, c4 P
substances by the respective effective dates:
+ D3 f* c8 E9 _9 m) A# w- Total lead content by weight for any accessible part of children’s product through
% o! h: h% {7 creasonably foreseeable use and abuse e.g. swallowing, mouthing, breaking, or other
: y% `4 p" x6 Hchildren’s activities, and the aging of the product:( b: N6 I( y; r- l
o more than 600ppm (beginning 10 February 2009);$ d+ ^$ w3 Y( X7 B# \! @
o more than 300ppm (beginning 14 August 2009);
( j$ }4 h9 X% b0 Q2 J0 Io more than 100ppm (beginning 14 August 2011);- _) Y' I- F; L
- Lead in paint and surface coating in max concentration of 0.009% or, more than 2μg
$ U7 B/ @2 k& i' ~1 k/ mof lead in a total weight ≤ 10mg of paint or other surface coating or in a surface area ≤
4 D: O7 m; s! x8 W" {+ f1cm2 (beginning 14 August 2009);
$ S) s# r8 C7 p; y6 ^4 ?7 ?- Phthalates (DEHP, DBP or BBP) in concentrations exceeding 0.1% by weight of% i8 W- N* c) y* F' Z1 z
children’s toy or childcare article, or phthalates (DINP, DIDP or DnOP) in6 e; J) K7 k9 ~" d: W8 i. t
concentrations exceeding 0.1% by weight of children’s toy that can be placed in a
$ j! }& \1 F% g) m: ]6 ^2 ^& }child’s mouth or childcare article (beginning 10 February 2009).6 C0 v# Q" a( b2 C3 q. C5 j* {
The Act also specifies ASTM F963-07 Consumer Safety Specifications for Toy Safety as
# X1 W. @0 m2 \; Y7 h' smandatory standard under the Consumer Product Safety Act and demands rulemaking process for
* F& u* Q! V8 ]2 K12 specified durable nursery products for use by children under the age of five years.
& \6 m( y) E4 k. AThe Act further requires that children’s product and its packaging should come with a tracking" x4 B( v& r- x% |# g; j
label that allows officials to trace a product back to its factory in the event of a recall. Any, I. G, C/ ?) J4 V# a# k" _
advertisement for direct marketing shall carry appropriate cautionary statement for product that

Civil penalties for violation of any CPSC regulations are increased from US$5,000 to
) H+ f( V2 |9 q+ c2 }- }US$100,000 for individual violation or up to US$15 million for violations involving multiple( x8 q3 Y& R& j3 ^
