In order to ensure a high level of safety of toys for the EU markets, revision of the Toy Safety2 U1 ]9 Q: w( I
Directive 88/378/EEC has been adopted by the European Parliament on 18 December 2008.
* g( b T2 R, N7 dPublication of the revised directive on the Official Journal is expected in first quarter of 2009.% }' u: }' \: k& J5 w' x
The revision shall replace the current 20 years old toy safety directive that does not adequately
& J9 l* I$ v% u! G' F7 Adeal with the risks and dangers of newly toy designs.
% j# g: Q9 Z1 u" q' JProvisions have been laid down for obligation of manufacturers, importers and retailers of toys,
- d) d& N+ l9 Q v5 |while the essential safety requirements of toys have much more related to the chemical properties# ?# r( r/ M' Q7 J
and labeling of toys.
1 [1 l# A3 f) sObligation of toy manufacturers:# ^* l' Z* e6 W* j/ P" e
a. To ensure their toys have been designed and manufactured
h1 V/ p) L2 Cin accordance with the essential safety requirements;
) {5 F! m# O, p9 ^. p. ?. qb. To draw up a complete product file for each toy and to carry0 }) v+ P$ O6 M1 V4 k
out conformity assessment prior to marketing of toy;7 t8 C, W+ u) a; H J3 f! L/ x
c. To draw up an EC declaration of conformity based on the* P# R. |1 J1 b( { y4 H
assessment procedure and affix the CE marking;4 C0 q7 S" }7 I8 u3 j. G6 d: p
d. To have unique identification by type, batch or serial or model number or any other( X+ z9 z, D; y, F3 E: ]
element on the toy or packaging or document accompany the toy;
1 k0 [0 Z- h3 _$ w$ u, i( ue. To accompany toy by appropriate safety warnings and instructions in a language or
9 G% ]- j$ ~' u) l r* O8 llanguages easily understood by consumers;9 i5 T N( _- v
f. To keep the technical documentation and the EC declaration of conformity for a period of
) [% Y6 \/ ]2 t; h5 {; b) f, v& uten years after a toy has been placed on the EU market (This also applies to the! U" f' P" I( c+ h' y( v! B
authorized representatives and importers of toys);
8 Q5 Q* U) y9 F+ ag. To indicate their name, registered trade name/mark and address on the toy or packaging or1 `8 y7 P5 C) p
document accompanying the toy (This also applies to the authorized representatives and" x* [# O1 C) _% n
importers of toys).
G7 z, p, Y+ SEssential safety requirements of toys have been amended with following additions:& A# w% {0 S0 w3 k$ [# \
a. Where appropriate, toys shall bear warning label that specify appropriate user limitation.
1 J: L# \6 ?* B' cHowever, warnings that contradict the intended use of the toy are prohibited, e.g. label+ U4 p) h, O3 ~4 {2 f
likes "Warning: Not for use by children under three years of age" on infant toys (e.g.+ O q0 D4 J6 y
rattle) will not be allowed;9 v$ G" Z) j0 Z/ e% B4 a6 Z- S
b. A toy intended for children under 36 months must be designed and manufactured in such. k2 `. n( |# [ A" [( W0 c
a way that it can be cleaned. A textile toy shall be washable, except if it contains a
- X7 U' l) V$ M! S* S$ gmechanism that may be damaged if soak washed;
; B" F, W8 M/ g4 W/ dc. Toys attached to a food product that must be consumed in order to get direct access to the# j1 U3 P$ h% Y0 @
toy shall be prohibited, whereas toys contained within food or mixed with a food product
- E1 P3 L6 ~' [: Cmust have their own packaging;# F+ m5 E+ a4 z: |; `9 L. R
d. Substances that are classified as carcinogenic, mutagenic or toxic for reproduction
0 v, S n2 T) f4 R3 M+ A# @9 |(CMRs), category 1A, 1B or 2 (except for nickel in stainless steel) shall not be used in& T, C1 _) B/ b
