1. Toys made available on the market shall bear the CE marking.2 }4 j/ P3 n0 L* E
2. The CE marking shall be subject to the general principles set out in Article 30 of Regulation (EC) No 765/2008.# m; Z" p" @4 F+ E) A
3. Member States shall presume that toys bearing the CE marking comply with this Directive.

Toys not bearing a CE marking or which do not otherwise comply with this Directive may be shown and used at trade fairs and exhibitions, provided that they are accompanied by a sign which clearly indicates that they do not comply with this Directive and that they will not be made available in the Community before being brought into conformity.

1. The CE marking shall be affixed visibly, legibly and indelibly to the toy, to an affixed label or to the packaging.3 i; t$ B4 l5 L. @
In the case of small toys and toys consisting of small parts, the CE marking may alternatively be affixed to a label or an accompanying leaflet. Where, in the case of toys sold in counter displays, that is not technically possible, and on condition that the counter display was originally used as packaging for the toy, the CE marking may be affixed to the counter display./ d0 m$ Z+ w' W2 O$ R+ ]
Where the CE marking is not visible from outside the packaging, if any, it shall as a minimum be affixed to the packaging.8 a: o$ o" h" S" ?2 X, W" ~$ I6 W
2. The CE marking shall be affixed before the toy is placed on the market. It may be followed by a pictogram or any other mark indicating a special risk or use.( b6 u- k. @' `% U( v- k

根据以上要求，顶楼的标志是不构成CE标志滥用的。欧盟关于严惩CE标志滥用是指不符合指令法规而打上CE标志混入欧盟市场的产品，有点类似于中国所说的假冒伪劣产品，与标志的部分缺失或错误关联性并不强，请不要混淆概念。

l& N- X1 } y6 Y E9 j所以楼主所展示的CE标志还是可以接受的，请验货人员或客户不要过于敏感，市场监察是不存在问题的。当然，顶楼的标志确实有点画蛇添足，完全不必增加外框。是否满足比例要求，照片无从查实。6 ]" ]4 ?( l, M' F
