This opinion is based on Article 9 of Council Directive

) Y$ h+ |. H9 t0 C0 Z1 ?equipment designed for use within certain voltage limits (1). It

In accordance with Article 5 of Directive 73/23/EEC, references
9 X+ h( d5 w" N: y) x6 m3 D6 oto harmonised standards EN 60335-1 and EN 60335-2-9 were% J+ g( E) O% k$ \2 D
published in the Official Journal of the European Communities (2).5 Q, R/ y3 @8 t8 T: R) k( c& C
Those standards, adopted by the European Standards Body
$ P( {2 p# J/ aCenelec, are entitled as follows:
/ G* b4 H6 \( _2 l* O— EN 60335-1 Safety of household and similar appliances
7 }3 C5 h( o" X9 y— Part 1: General requirements.
0 E/ D3 w( V! i— EN 60335-2-9 Safety of household and similar appliances
: p1 ~8 ?: Q. V* q. N— Part 2: Particular requirements for+ B2 B9 W' ~, a( |+ Q4 v* ^
toasters, grills, roasters and similar' w- x0 T7 E- [+ B
appliances.
4 `. E* |0 l* Y( ^In the context of an application of the safeguard clause
9 q0 F- m5 ?( C; u1 u0 F$ r; c$ Yprocedure in accordance with Article 9 of the Low Voltage
- }$ _" s; u; w# a( W$ PDirective, a shortcoming in the harmonised standard! v* P( g: y M" h. N# e
EN 60335-2-9, applied in conjunction with EN 60335-1, was
0 m$ M/ O( } `1 n; s3 F3 b7 dbrought to the attention of the Commission.9 C# G2 x' E7 o; {8 f" y! A
This refers to the risk of high non-working surface' W+ S3 M; c; B: i" o m7 U
temperatures of apparatus covered by EN 60335-2-9. This9 D+ I. l o/ P+ l# y- }* g }4 B
standard, in its current version, does not address the risk in
' E4 L2 u9 g; y+ T) ] x6 f" C& C/ \relation to non-working surface temperatures. The safety
5 C) Q2 x9 r% i K) i- Tobjectives, as laid down in Annex I, Section 1(d) and 2(b) to
. N; n) v3 q1 D' q9 V$ @Directive 73/23/EEC require electrical equipment to be# x# W, X$ b$ T: M5 R# `) @
designed and manufactured so as to ensure that protection' Q' B- T' r0 n" s y) D
against hazards in relation to surface temperatures is assured.% q9 E6 v. o( v5 D. G- _6 }1 m
Due to the absence of adequate specifications in relation to
' }' u9 `1 P3 K! C. d# Nnon-working surface temperatures, EN 60335-2-9 cannot% `4 E: }, h, t5 {* V: F, q" |
therefore necessarily guarantee full compliance with the Low
- u0 {* e+ Z2 Y$ i2 iVoltage Directive. In relation to the hazards in connection with
, \: d3 c/ {* c6 ?; @( s2 ^non-working surface temperatures, EN 60335-2-9 (clause 11). M4 y$ v) V3 |, b
and EN 60335-1 (clause 11), as listed in the abovementioned% U7 z2 J6 e e( @
publication in the Official Journal of the European Communities,
+ P) O, v: A) I% aare therefore not regarded as giving a presumption of" ?) C8 B, d' \' `" a3 ^ k& }
conformity with the stated safety objectives./ \: s. c1 u; w% O
These conclusions as detailed were supported by the representatives
- t0 E1 t7 o* E: [8 b+ sof national administrations at the meeting of the Low4 ?! t# l& Q2 u2 |. J0 t7 d# K
Voltage Working Party of 17 and 18 June, 1999.9 R( i& f. Q% b [) M8 [$ V/ [
The European Standards body Cenelec has been requested by
3 F0 y, @8 V; e8 h+ [/ i1 athe Commission to ensure that the abovementioned hazard is7 E/ `( H; n3 d/ f" U7 F7 o
adequately addressed in a revised version of this standard. A
7 {4 y0 n9 {" ~ drevision of EN 60335-2-9 is currently under way.
$ a0 V2 @5 p0 U) X7 XIn the absence of a revised harmonised standard, manufacturers,+ _* y- S! P8 Y& z2 K0 k
when establishing compliance of relevant electrical
, d3 N/ L! F' l- J4 E K2 F% K% k7 ?equipment with the Low Voltage Directive, must therefore
' m) m. i+ ?# [, p7 m/ Caddress the risk of non-working surface temperatures. This
$ A$ Y" w- ^ d' E. q: Q+ emay require a risk analysis and assessment in order to ensure$ J6 E$ T i5 a
that equipent is designed and manufactured in such a way as to
* p4 u6 S! r+ }! Y9 z2 S, n9 freduce as much as is reasonably possible the risk in relation to& [9 }3 R! u3 Q1 c0 }; ]1 G7 h! t
non-working appropriate surface temperatures. |
