Although all theChristmas Decorations could have some appeal to children, there were some which were generally regarded as decorations and would not be deemed to be toys. However, the items which were soft bodied were more likely to be considered appealing to small children by the parents. Indeed, it appears that the only reason the items are labelled as decorations is to avoid liability under the Toys (Safety) Regulations. There is a need for further clarification regarding the status of these items so that manufacturers/importers can be appropriately advised. This determination will finally need to come from the courts but guidance from the European Commission would assist both enforcers and those in trade.
